Article IX(3) of the Treaty defines a nuclear weapon State as one which manufactured and exploded a nuclear weapon or other nuclear explosive device prior to 1 January 1967, a date chosen precisely to close the category, and the five that satisfy it are the United States, the Soviet Union and now Russia, the United Kingdom, France and China, who are also the permanent members of the Security Council. France and China acceded only in 1992, long after the Treaty entered into force in 1970, but the definition is by conduct before the cut off date and not by date of accession. India, Israel and Pakistan are not parties to the Treaty at all; India's tests of 1974 and 1998 postdate the cut off, so even accession would not confer the status, and India's position has been that the Treaty is discriminatory in freezing an entitlement by reference to an arbitrary date. The elimination route is that any option including India, Israel or Pakistan must be wrong, which disposes of (b), (c) and (d) together, so a candidate who knows only that India is not a recognised nuclear weapon State under the Treaty can answer the item.
